Issue implementing lower and upper body animations.

I'm trying to have the animations affecting the upper body (Applied with a mask) to work independantly of the orientations of the lower body but it just isn't working. The cause for this is the fact that a upper torso bone is copying the rotation of it's parent bone which is in the lower body. I'm trying to find a way to disconnect the two bone's rotations and simply can't find a good way to do it. Simply breaking the bone's parenting is out of the question as it will force me to re-do all the animations I've done thus far (2 days of work) All animations have keyframes for every bone in the rig and is imported in. The upper body is on a lower layer than the lower body with overide enabled and a mask for only the intended bones.,I'm trying to have the animations affecting the upper body (Applied with a mask) to work independantly of the orientations of the lower body but it just isn't working.
